The student will be researching and summarizing research data relating to the developing topic of mediation in relation to older adults and the law.

This project is a part of the Canadian Centre for Elder Law study on Elder and Guardianship Mediation. Recent legislative developments in the area have put emphasis on mediation in many situations regarding elder care and mental capacity issues. The student would be performing research regarding legal, ethical, and social issues raised by both mandatory and voluntary elder and guardianship mediation.
How do you plan to use the results of this project?
The document will be incorporated into the literature review and annotated bibliography that will be published at the completion of the overall project in August 2010.
What larger goal is served by undertaking this project?
Issues surrounding elder law are quickly gaining importance as Canada's demography shifts, and as the quality of life for the elderly increases. As the law is modified to adapt to changed circumstances, new issues arise that need to be resolved. Examining mediation in this context is important as its use is growing, and it may negatively affect vulnerable older Canadians.
